Hybrid process - doctors do not want to pay

Cologne - Christiane V. (48), personal name Thomas, was born as a hermaphrodite. Interpreted with ovaries, uterus, and an overly large clitoris, by a midwife as a penis. Misinterpreted ...
At 17 was Christiane, then operated on Thomas, from their perspective "forcibly made the man." Now the courts deal with the case. And for many years.
The medical liability of the Cologne Regional Court of Appeal has in the past year Christiane awarded for pain and suffering. Figures should the surgeon who her then the intact ovaries and uterus removed (ref. 25 O 179/07) and should have done it with testosterone therapy, "forced the boy."
But now the case files to be opened again. Reason: The doctor does not want to pay partout. He informed the court that he made at that time a medical perspective, everything was done correctly. And in no case was therefore willing to pay.
In the verdict the amount of pain and suffering had been left open. Nurse calls from surgeon Dr. Christiane L. 100,000. The judges of the medical liability of Appeal assessed the interference principle, as "illegal".
Reason: The doctors had removed his then 18-year-old female patient her internal sexual organs, without fully informing them beforehand. He was "in willful or malicious manner," the health of the applicant violated.
In a new hearing is set in the spring, the level of pain are discussed. After the first verdict Christiane had told the Express: "I am totally calm, I have a feeling that I had passed a test."
